Terms and Conditions of Use – Iconstone
1. Definitions
- “We” refers to Iconstone, the supplier of the goods.
- “Customer” refers to the individual or organisation specified in the order confirmation as the purchaser of the goods from us.
- “Goods” refers to the products ordered from our website or brochure.
- “Writing” refers to written communication sent to our registered office and excludes email.
- “Registered Office” refers to Iconstone’s official business address.
- “Acceptance” refers to the confirmation of your order via email, postal address, or verbal acceptance by telephone.
- “Custom Made” refers to any bespoke order prepared in specific quantities or specifications less than a full pallet.
2. The Contract Between Us
2.1 Our website and brochures are intended for customers based in the UK, and delivery of goods is restricted to the UK mainland. Any typographical, clerical, or other errors in sales materials may be corrected without liability.
2.2 Orders are only accepted after full payment for goods and delivery has been received. Upon payment, we will confirm your order via an Acceptance notice, creating a legally binding contract.
2.3 By placing an order, you warrant that you:
- Are legally capable of entering into a contract.
- Are at least 18 years old.
- Reside in the UK.
- Accept these Terms and Conditions.
2.4 When we provide advice on product suitability, we rely on the information you provide. You must ensure all details, designs, and specifications are accurate and supplied in a timely manner.
2.5 If goods are manufactured based on your specifications, you agree to indemnify Iconstone against any claims relating to intellectual property rights arising from those specifications.
2.6 Any variations to these Terms must be in Writing and signed by one of our Directors.
2.7 We reserve the right to adjust product specifications as required by statutory regulations or to improve product quality without materially affecting performance.
3. Price
3.1 Prices for goods are as displayed on our website or current price list.
3.2 Delivery charges are calculated separately and vary depending on location.
3.3 Payments by credit card are only deemed effective upon receipt of cleared funds.
3.4 We reserve the right to adjust prices prior to delivery due to:
- Increases in costs beyond our control (e.g., raw materials, labour, transport).
- Changes in delivery dates, quantities, or specifications requested by the customer.
- Delays caused by insufficient or incorrect information provided by the customer.
4. Right to Cancel
4.1 You may cancel your order within 7 working days of receiving the goods without penalty.
4.2 Custom-made goods cannot be cancelled.
4.3 To cancel, you must notify us in Writing at our registered office, providing details of the goods and delivery.
4.4 If goods have been delivered, they must remain in their original packaging and be returned at your cost and risk. Refunds will be adjusted for any damage or loss in resale value.
4.5 Refunds will be issued within 30 days of cancellation, less delivery charges and a 20% restocking fee.
5. Cancellation by Iconstone
We reserve the right to cancel your order if:
- There is insufficient stock.
- Delivery is not possible due to location or accessibility.
- The goods were listed at an incorrect price.
- Payment cannot be processed.
Refunds for cancelled orders will be processed within 30 days.
6. Delivery of Goods
6.1 Delivery will be made to the address provided at checkout. Additional charges may apply for redelivery due to:
- Incorrect or incomplete address.
- Inaccessibility or unsafe conditions.
- No recipient available to accept delivery.
6.2 Deliveries are made within 30 days unless otherwise agreed in Writing.
6.3 Standard delivery is kerbside drop only. Delivery onto private property is at the customer’s risk unless caused by our negligence.
6.4 Customers must inspect goods upon delivery and report any damages immediately.
7. Risk and Ownership
7.1 Risk of damage or loss passes to you upon delivery.
7.2 Ownership remains with Iconstone until full payment is received.
7.3 You must store goods in their original condition and not install or modify them until payment is complete.
8. Liability
8.1 We are not liable for defects unless notified in Writing within 5 working days of delivery.
8.2 Liability is limited to repairing, replacing, or refunding defective goods.
8.3 Natural materials may vary in colour and texture. Samples provided are indicative only. Refunds will not be issued for natural variations.
8.4 We are not liable for indirect losses, including loss of profits or business.
9. Returns
Returned goods must be in original packaging and in a resaleable condition. A 20% restocking fee and return transport costs apply. Refunds will be processed within 30 days after inspection.
We do not accept returns of leftover or excess materials.
10. Collection
Some products are priced for collection only. These prices include VAT but exclude delivery charges. Customers must contact us for delivery arrangements.
11. Events Beyond Our Control
We are not liable for delays or failure to deliver due to circumstances beyond our control (e.g., extreme weather, strikes, supply chain disruptions).
12. Safety Precautions
- Always wear protective footwear, gloves, and respiratory protection when handling or cutting products.
- Handle crates and packaging with care to avoid injury.
13. Data Protection
By placing an order, you consent to Iconstone using your personal information for processing and delivering your order.
